Welcome to Xbook. If you continue use our Xbook software & or Xbook website (referred to as a “service”) you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Xbook Pty Ltd relationship with you in relation to this service.

The term “Xbook Pty Ltd” or “us” or “we” or “our” refers to the owner of the service. The term “you” refers to the user or viewer of our service.

The use of this service is subject to the following terms of use:

1. Introduction

a. Welcome to Xbook, we hope you are enjoying our website and the services we offer through it.
b. The content of the pages of this service is for your general information and use only. It is subject to change without notice.
c. By using Xbook website and / or our software you agree to abide by the terms and conditions set in this document, others wise please refrain from entering our website and / or using our software.


2. Software

a. Please read the following requirements carefully, before installing the Xbook software, using it, copying it or passing it on to a third party. If you do not agree with these terms and conditions, do not install or use the software.
b. Xbook P/L will give you the authority for installation and usage of the software.
c. You are allowed to make copies of the software and pass it on to others.
d. To sell, rent or use the software for leasing is prohibited.
e. The commercial assignment of the Xbook P/L software is explicitly forbidden without a written authorisation.
f. You are prohibited from reverse engineering, decompiling the Xbook P/L software, or trying to determine the source text or any other informations about the data structure.
g. Xbook P/L reserves the right to take any action it deems appropriate if and when it feels any of the items specified in this section have been breeched.
h. In no event will we be liable to you for any damages, including any lost profits, lost savings, or other incidental or consequential damages arising from the use or the inability to use the software and/or the Xbook website (even if we or an authorized dealer or distributor has been advised of the possibility of these damages), or for any claim by any other party.
i. Please refer to Software License Agreement within the Software package when installing it on your PC for the comprehensive Software License Agreement details.


3. Orders

a. Only upon the receipt of both confirmation notices from Xbook that state your order has been uploaded successfully and that payment was successful, can you consider the order accepted and in production. In case you selected the option to send your completed file on a CD to Xbook via post, this process will take longer.
b. Please make sure to update your software version with every use of the software. An update message will pop up automatically every time the software is accessed, simply accept. This is to make sure you are working with the latest version, as well as the latest price list. The updated price file will appear on our website.
c. Due to the automatic process involved in printing your photobook please note that we can not control its content nor can we be held responsible for any errors such as spelling mistakes. The photobook will be printed just as it appears in the ‘preview’ screen. Please proof read your photobook prior to processing the order !
d. All completed orders are stored by Xbook for a period of 1 month only, after which they will be deleted.
e. Please note, due to differences between various screen resolutions, differences between on-screen and in-print colour management and similar issues, there might be a variation of up to 25% in colour, Xbook can not be held liable for such instances.

4. Delivery

a. Xbook does its best to complete and dispatch all orders within 10 working days from receipt. If for whatever reason delivery will be delayed we will contact you, however a delay in delivery will not be accepted as a reason for an order cancellation or request for any form of compensation.
b. All Xbook photobooks are professionally handled and packed in dedicated packaging to avoid any damage during delivery.
c. Xbook photobooks are delivered using Australia Post express service / our courier service and are delivered to your designated address.


5. Liability

a. Xbook P/L will not accept any liability for damage or loss of files.
b. Xbook emphasizes that the quality of the prints in the photobook albums will never be better than is expected according you to what see on your PC screen using the ‘preview’ option in the editor.
c. Xbook’s liability is limited to errors which are related to production, shipping and delivering the photobooks.
d. You are solely responsible for all proofing of the photobook content, including text, images and layouts.


6. Copyright

a. Xbook will not be held liable for any copyright issues relating to your photobook material, your are solely responsible for all copyright issues concerning your order.
b. Xbook does not accept any responsibility for the contents of the order files you submit.
c. In ordering and distributing your printed photobooks you are solely responsible for strictly observing all related laws within Australia and those countries to which the Xbook photobooks are to be distributed.

7. Guarantee

a. Any and all complaints must be submitted to Xbook within 14 days of photobook delivery date. Please contact us on sales@xbook.com.au
b Xbook will investigate each complaint and should it be found to be justified Xbook will, at its own discretion re-supply you with a new photobook ( reprint existing order only ) or refund you. The original / damaged photobook must be return to Xbook P/L at your expense.

8. General

a. Improper use of this website and our software is forbidden, this includes but is not limited to usage of copyright material, pornographic material, or any other illegal content
b. Xbook P/L will not be held liable for such improper use of its software, you are solely responsible for all copyright issues relating to your order.
c. The use of this website and our software is for those people that have filled in the membership details or have otherwise supplied us with their full details, only true and legitimate email addresses and personal details are to be used.
d. Underage children may use the website and our software with the permission of an adult who is the credit card owner ( for payment purposes) and registers under his / her name.
e. Xbook P/L maintains the right to to deny access to this website and our software to anyone who we deem has acted against the letter and spirit of these terms and conditions.
f. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
g. Your use of any information or materials on this service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this service meet your specific requirements.
h. This service contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
i. Unauthorised use of this service may give to a claim for damages and/or be a criminal offence.
j. From time to time this service may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
k. Your use of this service and any dispute arising out of such use of the service is subject to the laws of the state of Victoria, Australia.
